| that there were, in Article Three with courts | 0:28 | |
| they could use various tools available as interrogators | 0:32 | |
| to induce cooperation without using torture. | 0:35 | |
| They could, you know, offer credit for time served | 0:39 | |
| and all kinds of other things | 0:42 | |
| that aren't available in the military commission system. | 0:43 | |
| And then they could even use the defense lawyer | 0:46 | |
| assigned to represent someone as an ally to say, | 0:48 | |
| you better cooperate because, you know, | 0:51 | |
| you're really facing some serious situation here, | 0:53 | |
| maybe you can improve your situation a little bit. | 0:55 | |
| And then once someone was convicted, | 0:59 | |
| the trial happened quickly, compared to Guantanamo, | 1:02 | |
| the verdict was upheld on an appeal, | 1:07 | |
| the person disappears into the Florence supermax, | 1:10 | |
| never to be heard from again, | 1:12 | |
| while the, sort of circus of an attempt | 1:13 | |
| to bring even the big, get through pretrial hearings, | 1:17 | |
| in a case the commission system | 1:20 | |
| continues to be ineffective. | 1:22 | |
| And so, it will be, you know, | 1:25 | |
| there were practical or pragmatic arguments for this | 1:28 | |
| that the professionals had | 1:31 | |
| totally apart from the political rhetoric | 1:33 | |
| about which way was being tougher on terrorism. | 1:35 | |
| One of the things that'll be very interesting to watch for | 1:38 | |
| is how national security professionals | 1:39 | |
| in the Trump administration handle these issues | 1:42 | |
| as they arise and whether they make such arguments | 1:46 | |
| and whether they're listened to, | 1:48 | |
| or whether there's a desire to show a different approach | 1:49 | |
| that prevails over that kind of an argument. | 1:54 |
