Éditorial de Jean Dominique après le verdict de la Cour de cassation sur la décision prise par le président Préval, le 11 janvier 1999, concernant le mandat des parlementaires. La Cour a décidé qu’elle ne pouvait juger un conflit entre la 46e législature et l’exécutif. Calixte Delatour, avocat d’Edgard Leblanc et Vasco Thernelan, a utilisé le verdict de la Cour de 1992, rejetant l’accord de Washington entre Jean-Bertrand Aristide et les putschistes, comme précédent. Dominique explique qu’il existe une importante différence entre 1992 et 1999. En 1992, il y avait un gouvernement militaire ayant renversé un gouvernement démocratiquement élu. Les putschistes, dont Mireille Durocher Bertin était l’avocate, étaient responsables de la mort de milliers d’haïtiens et avaient utilisé le viol comme arme politique. The court ruled that it did not have the authority to adjudicate the conflict between the 46th legislature and the executive. Calixte Delatour, the attorney for Senators Edgard Leblanc and Vasco Thernelan, used the Cour de Cassation's 1992 decision to reject the Washington accords between Jean-Bertrand Aristide and the coup leaders as a precedent. Dominique points out the fundamental differences between 1992 and 1999. In 1992, the government was run by a military junta that had overthrown the democratically-elected government. The coup leaders, represented by lawyer Mireille Durocher Bertin, were responsible for the deaths of thousands of Haitians and the systematic, politically-motivated rape of women and girls.
