  • Chenet Jean-Baptiste of POHDH speaks with Jean Dominique about justice, human rights, and impunity. Jean-Baptiste is critical of the Lavalas authorities for not pushing the justice agenda forward, to provide justice for victims of the Duvalier dictatorship, the transitional military government, and the coup years. He also criticizes USAID and the US government, which is funding judicial reform and supporting a justice system that is filled with former perpetrators and which does not serve the needs of Haitian victims (meanwhile, the US refuses to extradite Toto Constant). According to Jean-Baptiste, the judicial system is "conservative," which is to say a Macoute judicial system. He outlines the challenges of judicial reform. Jean-Baptiste criticizes Haitian institutions, including CRESFED and the Commission nationale de vérité et de justice. According to Jean-Baptiste, the Commission's report did not list the different parties responsible for the coup d'état (including the oligarchs that funded it), it failed to clearly highlight the CIA's role in financing FRAPH, and neglected to address the US's seizure of the FRAPH archives. They end by discussing the relationship between judicial reform and agrarian reform vis-à-vis Haiti's economic situation, and they discuss the importance of true democratic participation.

Jean-Baptiste critique le pouvoir Lavalas qui n’a pas fait progresser sa réforme judiciaire afin de donner justice aux victimes de la dictature des Duvalier, à celles des gouvernements militaires et aux victimes du coup d’état. Il critique l’USAID et le gouvernement des États-Unis, car ce sont eux qui financent la réforme judiciaire et qui soutiennent un système judiciaire où se retrouvent d’anciens bourreaux, et qui ne répond pas aux revendications des victimes (dans le même temps, les États-Unis refusent d’extrader Toto Constant). D’après Jean-Baptiste, l’actuel système judiciaire est conservateur, ce qui signifie que c’est un système judiciaire macoute. Il signale les obstacles qui entravent une vraie réforme judiciaire. Jean-Baptiste critique aussi certaines institutions haïtiennes comme la CRESFED et la Commission Vérité et Justice. D’après lui, le rapport de la Commission n’a pas donné la liste des responsables du coup d’état (parmi eux, des gens puissants qui ont financé le coup d’état), il n’a pas souligné le rôle de la CIA qui a financé le FRAPH, il n’a pas abordé la question de la CIA qui s’était emparé des archives du FRAPH. Dans les dernières minutes de l’interview, ils ont discuté des rapports entre réforme judiciaire et réforme agraire, par rapport à la situation économique du pays, et enfin ils ont parlé de l’importance de la vraie participation démocratique.
