(pencil scratches) - Bush, Cheney, Colin Powell, Condoleezza Rice, Rumsfeld, and countless others. Oh, well, most recently, this guy Rodriguez from the CIA, and Tenet, from the CIA, have all written books talking about my client's torture. They all admitted that he's been waterboarded. Hayden admitted it, admitted that they destroyed 90 videotapes. Everybody has conceded it was legal. We've got these memoranda right here from John Yoo. We know all this information. Can my client, through me, tell people what it was like to be waterboarded? Well, what his, what the other enhanced interrogation techniques were like? Nah. And why is that? Well, because everything that he says is presumably classified at the top secret level. It's ridiculous. Under Obama, it's become much more difficult to get any information out. If I've signed a dec-- get my client to sign a declaration, they won't clear it. They're telling me now that I have to tell them the reason why I want to use the declaration. But I couldn't do that, even if I wanted to, because to divulge my thoughts and strategies would be to violate the work product doctrine. And I can't give up my work product. I mean, that's not something I'm going to do. And I'm certainly not going to tell my opponents the very line attorneys who are handling the case against Abu Zubaydah, and let them make the determination as to whether it's a good use or not, that's ridiculous! I mean, but this is what, this is where the law has gone with regard to these detainees. There is no law. They can get away with it, and they know they can get away with it. And unless and until we can get some judges who really have got some balls to step in and say "I don't care whether the "DC circuit reverses me, this is wrong, "and this is my decision, "and I'm ordering this guy released."
